These terms are a contract between you and ATTN Please ltd, a company registered in England and Wales under number 16665743, registered office 3rd Floor, 86-90 Paul Street, London, England, EC2A 4NE ("we", "us", "Bamya"). They govern your use of Bamya Call at b-call.app — formerly bcall.app, which now redirects there — and everything it does.
By creating an account, signing in, or using the service, you agree to them. If you do not, do not use the service.
1. Who these terms are for
Bamya Call is a business product and is not offered to consumers. It is available to companies and to individuals acting in the course of a trade, business, craft or profession, and to nobody else.
By creating an account or purchasing a plan you confirm that you are acting in that capacity and, where you are agreeing on behalf of an organisation, that you have authority to bind it. In these terms "you" means both you and that organisation.
If you are acting wholly outside a trade, business, craft or profession, you may not use or purchase the service. If we become aware that an account is held by someone in that position, we may close it and refund any unused fees, at our discretion and without further liability.
We do not verify this, and we do not undertake to. The confirmation above is yours to give honestly.
Nothing in these terms operates to deprive anyone of rights that apply to them as a matter of mandatory law despite the restriction above; §23 states the limited effect of that.
2. What the service is
Bamya Call captures both sides of a call in your browser, transcribes it live in a range of languages, can translate it, and can pass the conversation to an AI model that suggests what to say next, drafts minutes, tailors a CV against a job advert, or answers a question about a photograph.
Nothing joins your meeting as a participant. Audio is streamed from your browser directly to our transcription provider and never reaches our servers.
The service is provided as it stands. We add, change and remove features; §20 covers how.
3. Accounts
You may register an account yourself, or receive one from us on request. Some accounts are instead created by a handoff from Bamya Leads, our sibling product, in which case access follows your membership of an organisation there and ends when that membership or entitlement does, typically within 15 minutes.
To register you must be at least 18, give a real and current email address that you control, and give accurate details including the name of the business you are acting for (§1). You must confirm your email address before you can record anything — the account works immediately, capture does not. We may refuse or close an account registered with details we reasonably believe to be false. One account per person, and one trial per customer — see §11 on multiple accounts.
We may limit how many new accounts are opened in a given period, and may decline a registration without giving a reason.
You are responsible for your credentials and for everything done under your account. Do not share them, and do not let anyone else use your account: a seat is one person, and colleagues get their own. Tell us promptly at yavo@bamya.co if you believe your account has been compromised.
We may create, suspend, or remove accounts within a customer organisation on the instruction of that organisation's administrator.
4. Your obligations when recording — the important one
You are responsible for the lawfulness of every recording you make.
Bamya Call is invisible to the other people on your call. It does not join the meeting, does not announce itself, and does not obtain anyone's agreement on your behalf. That is entirely yours to do, and it is a real legal obligation, not a courtesy:
- Tell every participant that the call is being transcribed, before it starts.
- Obtain their consent where the law where you or they are requires it. In several US states the consent of every party is required and recording without it is a criminal offence. Under UK and EU data protection law you need a lawful basis for processing their words, and in most business settings transparency is a minimum.
- Do not record where you are prohibited from doing so — by law, by the terms of the meeting platform you are using, by your employer's policy, or by a duty you owe to the other party.
You must not use the service to record covertly, to record a person who has objected, or to capture conversations you have no right to be part of.
You indemnify us under §19 for claims arising from your failure to do any of this. We will not defend a claim that you recorded someone who did not know.
5. Acceptable use
You must not:
- use the service unlawfully, or to facilitate anything unlawful;
- record conversations in breach of §4;
- upload material you have no right to supply, including someone else's CV or confidential documents you are not entitled to share;
- use the service for calls whose content is predominantly special category data — clinical consultations, occupational health, criminal-matter legal advice, safeguarding — without agreeing that use with us in writing first;
- attempt to circumvent access controls, ownership checks, usage limits or the entitlement system;
- probe, scan or test the security of the service, or interfere with its operation, other than in a manner we have agreed in writing;
- resell, sublicense or provide the service to third parties as a service of your own, other than under a written arrangement with us;
- extract prompts, model instructions or other non-public components of the service, or use it to build a competing product;
- use automated means to create accounts or generate load beyond normal use;
- create more than one account in order to obtain repeated trials, allowances or refunds (§11).
Breach of this section may result in suspension under §16.
6. AI output — what it is and what it is not
The assistance features generate text using a third-party AI model. Treat everything they produce as a suggestion to be checked, never as fact and never as advice.
Specifically:
- We do not warrant that AI output is accurate, complete or suitable. Models produce fluent text that can be wrong. The assistant may state something with confidence that is not true.
- It is not professional advice. It is not legal, financial, medical, employment or any other kind of regulated advice, and must not be relied on as such or passed off as such.
- You are responsible for what you say and do after reading it. A person reads every suggestion and decides whether to use it; that decision is yours and its consequences are yours.
- Do not use output to make decisions with legal or similarly significant effects about people — hiring, dismissal, credit, access to services — without meaningful human review. The service is not designed or assessed for that, and we do not support it.
- Output is not unique to you. Similar prompts may produce similar text for other customers. We make no claim that output is original or non-infringing.
7. Transcription accuracy
Transcription is imperfect. Words are misheard, particularly across accents, names, numbers and technical vocabulary. Where both voices share one microphone — phone mode — speakers are separated by an algorithm that is explicitly unreliable, and a line attributed to one person may have been said by another.
A transcript produced by the service is a working record, not a verbatim or evidential one. Do not rely on it as proof of what anyone said. Do not present it as a certified or legal transcript. If a call needs an authoritative record, use a service that provides one.
Translation carries the same caveat, doubled: the original is always stored alongside the translation for exactly this reason.
8. Your content
You keep everything you own. Transcripts, documents you upload, scenarios, instructions and the write-ups generated from them belong to you or to whoever owned them before — we claim no ownership of any of it.
You grant us a limited, non-exclusive licence to host, process, transmit and display that content for one purpose only: operating the service for you. That licence includes passing it to the processors in Annex B, because the service does not function otherwise. It ends when the content is deleted.
We do not use your content to train AI models. We operate none of our own, and we use the paid tier of our AI provider's API, under which submitted content is not used to train theirs. We do not read your transcripts except where you ask us to investigate a problem, or where we are legally compelled.
You are responsible for having the rights to everything you supply, and for the accuracy of it.
9. Our intellectual property
The service — its software, interface, design, documentation, and the prompts and model configurations behind the assistance features — belongs to us and to our licensors. Nothing in these terms transfers any of it to you. You get a non-exclusive, non-transferable right to use the service while your account is active and these terms are observed.
The names Bamya, Bamya Call and Bamya Leads and the associated marks are ours.
10. Confidentiality
Each party will keep the other's confidential information confidential, use it only for the purposes of these terms, and protect it with at least reasonable care. Your conversation content is your confidential information. Our non-public technical and commercial information is ours. This does not apply to information that is public through no fault of the recipient, was already known, is independently developed, or must be disclosed by law — in which case the disclosing party is told first where that is lawful.
This section survives termination by three years, except for conversation content, where it survives indefinitely.
11. Plans, allowances and payment
Plans and allowances. Paid plans provide an allowance of recorded hours per billing period and access to a defined set of modes. Some plans cap how many of those hours may be used on assisted (AI) features; the interface shows your remaining allowance before and during a call, and refuses to start a capture once it is spent.
Allowances do not roll over — an unused hour at the end of a period is gone, not banked. The free allowance is a one-off trial that does not reset. Hours you buy as a top-up, and hours we grant you, never expire and survive a downgrade or the end of a subscription.
How hours are counted. An hour of allowance is an hour of wall-clock recording time, whatever the call is doing. A call that captures your microphone and the far end separately costs the same as one that captures a single microphone: one hour of recording is one hour. Time is metered while a capture is running, not while a conversation merely sits open.
Billing. Subscriptions are billed in advance through Stripe and renew automatically until cancelled. We are not currently registered for VAT, so no tax is added at checkout. If we become registered, tax will be shown and added at checkout from that point, and prices quoted before then are exclusive of it. You are responsible for providing valid billing details and for any bank or card charges.
Starting immediately. When you purchase, you ask us to begin providing the service at once rather than waiting, and you acknowledge that where any right to withdraw applies to you, beginning immediately means you will be charged in proportion to what you have used if you later withdraw, and that the right is lost entirely once the service has been fully provided. We record that you gave this consent, and when. If you would rather the service did not start until any withdrawal period has passed, do not purchase — tell us and we will arrange it.
Cancellation. You may cancel at any time, effective at the end of the current billing period. We do not refund part-periods except where the law requires it (§23) or where we have materially failed to provide the service. Where a refund is due, it covers the unused part of your allowance. Hours already recorded have been supplied and are not refundable, because they cost us transcription and model usage at the moment you spent them.
Failed payment. If a payment fails, your plan continues while our payment provider retries. If it has not succeeded within 4 days, the account reverts to the free tier — keeping all of your data, losing the paid features and the plan allowance — until payment succeeds, at which point the plan is restored. Hours you bought or were granted are unaffected: they were paid for separately and survive a downgrade. We will email you when this happens.
Price changes. We will give at least 30 days' notice by email before a price change takes effect. A change never takes effect mid-period — it applies at your next renewal, and the price you are on now runs to the end of the period you have paid for. If you do not accept it, cancel before that renewal.
Deleting a conversation does not return hours already recorded. The hour was spent when the call was captured, not when the transcript was stored.
Abuse of trials and refunds. Trial allowances are one per customer. You must not create multiple accounts to obtain repeated trials, allowances or refunds, use false identities or payment details, or seek a refund for usage you have already had the benefit of. Where we reasonably believe an account exists for any of those purposes we may refuse or reverse a refund, withhold an allowance, close the accounts concerned under §16, and recover chargeback and processing costs. Nothing in this paragraph limits a genuine consumer's statutory rights under §23 — but a right exercised in bad faith, or through accounts created for the purpose, is not a genuine exercise of it.
12. Data, retention and deletion
Our handling of personal data is described in the Privacy Policy, which forms part of these terms. Where we process personal data on your behalf, Annex A applies and is the data processing agreement between us for the purposes of Article 28 GDPR.
In summary:
- Audio never reaches our servers. It is streamed from your browser directly to our transcription provider, which processes it in the European Union. Our own servers and backups are in the United Kingdom; the AI features are processed in the United States. Privacy Policy §7 sets out what that means.
- Transcripts kept on our servers are deleted at the end of the retention period set on the account — local only, or 7 days, 15 days, 30 days, 6 months or 1 year, defaulting to 30 days — measured from the last activity in the conversation rather than from when it was created. The window is fixed onto each conversation as it is created and does not change retroactively. Backups may retain content for up to a further 7 days; Privacy Policy §9 explains why.
- Local-only mode keeps transcripts in your browser and never sends them to us at all, with the single, stated exception of a per-conversation word count. It is the least durable option, not the safest one, and content held only in your browser is your responsibility to back up.
- Assistance features send your content to our AI provider regardless of the retention setting. The setting governs whether a copy stays with us, not whether one is sent.
Export. You can download any conversation, complete with its write-ups, at any time while it exists. Do this before a retention window closes if you need to keep it. We are not obliged to recover content that has been deleted on schedule, and after the sweep and compaction described in the Privacy Policy we cannot.
On termination, we will make your content available for export for 30 days, after which it is deleted on our ordinary schedule. Ask us in writing within that window if you need an export we cannot produce ourselves.
13. Availability
We aim to keep the service available and will give notice of planned maintenance where we reasonably can. We do not offer a service level agreement, uptime guarantee or credits, and the service may be unavailable through our own faults, our providers' outages, or maintenance.
Two consequences worth stating because of what this product is:
- Do not schedule a call on the assumption that live assistance will be available. If the transcription or AI provider is down, the features that depend on them will not work, and a call happens whether or not they do.
- The service is not a system of record. Keep your own copy of anything you need to be able to produce later.
14. Third-party services
The service depends on third parties: a transcription provider, an AI provider, a hosting provider and (once billing launches) a payment provider. They are listed in Annex B. We choose them carefully and contract with them on data protection terms, but we are not responsible for their acts or omissions beyond what §18 provides, and their own terms may apply to you where you deal with them directly.
We may change providers. Where a change materially affects the processing of your data, Annex A §7 governs how you are told and what you can do about it.
15. Beta and experimental features
Some features are marked as experimental, alpha, or restricted — the visual assistant is one. They are provided as is, with no warranty of any kind, may change or disappear without notice, and should not be relied on for anything that matters. We may withdraw them at any time.
16. Suspension
We may suspend an account or a feature immediately where we reasonably believe:
- it is being used in breach of §4 or §5;
- there is a security risk to the service, to you, or to another customer;
- payment is overdue beyond the period in §11;
- we are legally required to.
We will tell you why, and restore access once the cause is resolved, unless the breach is one we are entitled to terminate for. Suspension for cause does not entitle you to a refund.
17. Termination
You may stop using the service and close your account at any time by writing to us; if you are on a paid plan, cancellation takes effect as described in §11.
We may terminate these terms on 30 days' written notice, or immediately if you commit a material breach that is not remediable or that you fail to remedy within 14 days of being asked, or if you become insolvent.
On termination your right to use the service ends, §12 governs your content, and the sections that by their nature should survive — §6 to §10, §18, §19, §21 to §23 and Annex A — do.
18. Warranties and liability
Warranties. We will provide the service with reasonable care and skill. Other than that, and to the fullest extent the law allows, the service is provided "as is" and we exclude all other warranties, express or implied, including fitness for a particular purpose, accuracy, and uninterrupted availability. We specifically do not warrant the accuracy of transcription, translation or AI output — see §6 and §7.
What we never limit. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
What we exclude. Subject to the paragraph above, we are not liable for loss of profit, revenue, business, anticipated savings, goodwill or reputation, for loss or corruption of data, or for indirect or consequential loss, however arising.
Cap. Subject to the two paragraphs above, our total liability arising out of or in connection with these terms, in contract, tort (including negligence) or otherwise, is limited in aggregate to the greater of (a) the fees you paid us in the 12 months before the claim arose, and (b) £1,000.
Data loss in particular. Given §12 and §13, you accept that keeping your own copy of anything you need is your responsibility, and our liability for content lost through deletion on schedule, through browser storage eviction in local-only mode, or through your own clearing of site data, is excluded to the extent the law allows.
19. Indemnity
You will indemnify us against all claims, losses, damages, fines and reasonable costs (including legal fees) arising from:
- your recording of any person in breach of §4, including any regulatory fine, criminal complaint or civil claim brought by a participant in a call you recorded;
- content you supply that infringes a third party's rights or that you had no right to supply;
- your use of the service in breach of §5 or of any applicable law;
- your use of, or reliance on, AI output contrary to §6.
We will tell you promptly of any such claim, will not settle it without your agreement (not to be unreasonably withheld), and will let you control the defence where you confirm the indemnity applies.
This section does not apply to a consumer.
20. Changes to the service and to these terms
We may change the service. Where a change materially reduces functionality you are paying for, we will give at least 30 days' notice by email and you may cancel without penalty before it takes effect.
We may change these terms. Material changes are notified by email at least 30 days before they apply; continuing to use the service after that date is acceptance. If you do not accept, stop using the service and cancel — that is your remedy.
Changes required by law or to address a security risk may take effect immediately, and we will say so when we tell you.
21. General
Notices to us go to yavo@bamya.co; notices to you go to the email address on your account. Assignment: you may not assign these terms without our written consent; we may assign them to a group company or on a sale of the business. Entire agreement: these terms, the Privacy Policy and its annexes are the whole agreement between us and replace anything said beforehand, except that nothing excludes liability for fraudulent misrepresentation. Severability: if a provision is unenforceable, the rest stands. No waiver: not enforcing a right once does not waive it. No partnership is created. Third parties have no rights under these terms except as stated in Annex A. Force majeure: neither party is liable for failure caused by events beyond its reasonable control, though this does not excuse payment.
22. Governing law
These terms and any dispute arising out of them, including non-contractual disputes, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. A consumer resident in the EEA may bring proceedings in, and rely on the mandatory consumer law of, their country of residence.
That last sentence is not a drafting leftover from §23: consumer jurisdiction under Brussels Ia and the Rome I Regulation attaches whatever law the contract chooses, so stating it is accurate rather than generous.
23. Mandatory law
The service is not offered to consumers (§1). Where, despite that, a person is held to have contracted with us as a consumer, mandatory consumer law applies to them however these terms are written. In that event the exclusions and cap in §18 apply only so far as the law permits, the indemnity in §19 does not apply to them, and their statutory rights are unaffected — including the right to withdraw from a distance contract within 14 days, which, because they asked us to begin immediately (§11), entitles them to a refund of the unused part of what they paid and is lost once the service has been fully supplied. Their responsibility for lawful recording under §4 is unchanged: that is owed to the people they record, not imposed by us.
This section states the effect of law we cannot contract out of. It is not an offer of the service to consumers, and it does not waive §1.
Annex A — Data Processing Terms (Article 28)
These terms apply where we process personal data on your behalf, and form the data processing agreement required by Article 28(3) of the UK and EU GDPR. You are the controller; we are the processor.
1. Subject matter and duration. Processing lasts as long as your account is active, plus the retention and export periods in §12 of the Terms.
2. Nature and purpose. Transcribing, translating, storing, indexing for search, and generating written material from conversation content; providing the service described in §2 of the Terms.
3. Types of personal data. Voice converted to text (audio is not received by us); names and contact details; employment history and CVs; commercial information about companies and their staff drawn from Bamya Leads; images converted to text and immediately discarded; and whatever else participants say, which may include special category data (see Privacy Policy §4.2).
4. Categories of data subject. Your personnel; the other participants in calls you record; individuals named in documents you upload or in lead briefs.
5. Our obligations. We will:
- process personal data only on your documented instructions, which these terms and your use of the service constitute, unless required otherwise by law — in which case we will tell you first unless the law forbids it;
- ensure personnel with access are bound by confidentiality;
- implement the technical and organisational measures described in Privacy Policy §12, and keep them appropriate to the risk;
- assist you, so far as is reasonable and taking account of the nature of the processing, with data subject requests, with security, with breach notification, and with data protection impact assessments;
- notify you without undue delay on becoming aware of a personal data breach affecting your data, with the information you need to make your own notification;
- on termination, delete your personal data in accordance with §12 of the Terms and Privacy Policy §9, save where storage is required by law;
- make available the information reasonably necessary to demonstrate compliance with this Annex, and allow an audit no more than once a year on 30 days' notice, at your cost, subject to confidentiality and to not disrupting the service or exposing another customer's data. We may satisfy an audit request with our own documentation and our providers' certifications where these reasonably answer it.
6. Your obligations. You warrant that you have a lawful basis for every recording and every document you supply, that you have given participants the information required by Articles 13 and 14, and that your instructions to us do not breach data protection law. You are responsible for the matters in §4 of the Terms.
7. Sub-processors. You give general written authorisation for us to engage the sub-processors in Annex B. We will impose equivalent data protection obligations on each, and remain liable for their performance. We will give you 30 days' notice by email before adding or replacing one; if you reasonably object on data protection grounds within that period and we cannot accommodate you, either party may terminate the affected part of the service, and we will refund fees paid for the unused remainder of the term.
8. International transfers. Transfers outside the UK/EEA are made under the mechanisms in Privacy Policy §6 and §7 — Standard Contractual Clauses, the UK International Data Transfer Addendum, or an adequacy decision. Where the EU SCCs apply, module two (controller to processor) is incorporated by reference, with the docking clause enabled, the optional clause 7 included, clause 9(a) option 2 (general authorisation, 30 days' notice), clause 11 without the independent dispute resolution option, clause 17 governed by the law named in §22 of the Terms, and Annexes I, II and III of the SCCs populated by this Annex A and Annex B.
9. Conflict. Where this Annex conflicts with the rest of the Terms, this Annex prevails for matters of data protection.
Annex B — Sub-processors
Current as at 9 August 2026. This list must match Privacy Policy §6.
| Sub-processor | Purpose | Data | Location |
|---|---|---|---|
| Soniox, Inc. | Speech recognition and translation | Live audio, streamed from the customer's browser; returned text | European Union |
| Google LLC | AI features (Vertex AI) | Transcripts, uploaded documents, scenarios, photographs | European Union (primarily) |
| Microsoft Azure | Servers, storage, backups | All stored content | United Kingdom |
| Stripe Payments UK Limited | Payment processing (once billing launches) | Billing contact and card data | United Kingdom, with onward processing in the EEA and United States |
ATTN Please ltd also operates Bamya Leads. Where a customer uses both products, data flows between them as described in Privacy Policy §6; this is processing by us, not a sub-processor.
